Hello My spouse, who is on H1B, was laid off recently but is on notice period right now. We are planning to get the H1 changed to H4 before the grace period is over. I have an H1B with I140 approved. I need some guidance with some questions 1. When does the grace period start - the day the termination notice was received or the date when the notice period gets over? The separation letter that the employment continues until the last day of the notice period. 2. What is the process to get the H1 transferred to H1? 3. How long does CoS take these days? 4. Can one stay in the US while they are the decision on the CoS if it takes longer than the grace period? 5. How long does H4 application these days? Can it be done in premium processing? 6. Can one go out of the US and enter again while the application is pending? 7. Can I sponsor the H4 or does it have to be the employer? 8. Can one go back to H1 if an employer is found while the CoS or H4 application is pending? Thank you in advance.
