  1. I am planning to file extension of stay for my parents(B2 visa). I can file this online but I am confused if I can file single application or it should be two separate applications for my father and mother. Can someone clarify on this?
  2. I was hired in my current company in U.S. 2 years ago and now they want me to send to U.K. as we acquired a new company in U.K. for some time and it could be close to 1 year. If I spend 1 year outside U.S. as executive/manager, do I qualify for EB1? I don't want to spend 1 year in U.K. leaving my family here unless I get something in return. My priority date is 2016 and I am from backlogged country.
  3. @theace I would go with the reply(or the initial email) you received from consulate. Don't get hung up on what VISA officer told you during the interview. It could be a mistake from Visa officer and consulate sent email with actual reason for denial, correcting what VISA officer told you. Your best option is to consult immigration attorney and request consulate to waive your DUI conviction and issue VISA(official term is "Waiver of Visa Ineligibility"). Good luck!
  4. My wife is pregnant and she will be on maternity leave effective from 1/1/2020. Her project and H1B both end on 12/31/2019. She works in EVC model and don't have client letter to file H1B extension. Client agreed to take her back after 3 months. Because we don't have client letter to file extension, her employer is saying that she can file for H4 COS and H4 EAD. When she is ready to start working(after 3 months), even if H4 COS is pending, her employer says, we can file H1 and start working without leaving the country? Is this true?
  5. Why are you paying fine and agreeing for probation of 6 months if you didn't committee the crime? If possible go for trial and get case dismissed. If you are paying fine and agreeing for any period of probation, it implies to immigration matters that you are agreeing for what you are charged with and can cause troubles in future. Please note I am not a attorney and use this advice with caution.
  6. I was arrested for domestic violence misdemeanor and case was dismissed on trial date by Judge for lack of evidence. The case is also sealed. This happened 3-4 years ago and since then I have changed multiple jobs in multiple states and didn’t face any issues. By law, background companies shouldn’t report arrests which didn’t lead to conviction unless you are applying for Federal jobs or some sensitive jobs. Hope this helps.
