  1. You got the best possible outcome to your bad incident.So, What did you answer regarding 'arrest Question' on your OPT form. If you answered 'yes' and provided court certified disposition document ,you should be OK.
  2. As everyone suggest get a good criminal defense lawyer.Probably look someone who handles lot of cases in court that you are summoned. The best result will be dismissal/dropping of charges.So, try for it , given your husband is ready to support you. Your husband will not have issues with his H1. You will be Ok as long as you are not convicted.
  3. Congrats & Thanks for sharing your status in detail.It helps others.. You will be called for Secondary at POE, keep your documents that you had from police & court handy( Same that you showed at Embassy). It will be smooth do not worry , be truthful and you will be good. Regarding your L2 Revoking, Did they specially told , it is FBI Background check or USCIS Check..? Did you not expunge your Case? If so, your arrest/detention should not pop on FBI Check? Also can you please tell ,which Consulate did you go for VISA Stamping?
  4. Just be patient you will be fine.Sometimes it takes 4-6 weeks Are you fingerprinted when you were arrested(because you said police said it was detention) ?. Is your L2 revoked at POE? Were you working on L2? What is the reason did they say? Good that you got 221g pink , which allows you check your status online, some people that 221g white slip ,which does not allow it.They will running some more background checks to ensure you did not have any criminal record and these checks take more time at times
  5. This is bad part of this forum, people do not share there experiences in detail or answer once they cross over. For Raisa, it took 64 days in total,none can tell the reason for it .. In most of the cases( I know of this forum) it is 4 - 6 weeks. theft charges seems to get thru fairly quickly (3 weeks) , given they will not ask for Medical test;Other Charges - DUI, Assault etc takes 4 - 6 weeks. By the way, please write your case in full detail ,so someone can give more precise answer. Also dnt get worried , you will mostly sail thru it as long as you have no conviction ( just arrest) and please do your 2 cents to share about it latter.
  6. Raisa, can you share your experience in detail like when did the incident, when you traveled back what questions VO asked you, what documents you submitted. How long it took in total for you to get VISA It helps others a lot.
  7. Did you submit Court certified dismissal Order? If so, just wait on till they respond.you cannot rule out unless they say reject
  8. Raisa, I can understand your anxiety, unfortunately you have to wait till you hear back from USCIS. Be positive as your Case was dismissed with prejudice.I know 2 persons in this forum who got their VISA successfully with Charge like you,within 4-6 weeks.Even I have same issue with same result like you and yet to travel outside US.(but one day, I have to, and face what you are facing now).sometimes it gets delayed more as it is busy time for Embassy now (New H1-B stampings) so other than being patient you cannot do anything now.Please forum posted once you get update,it helps others like you.

Hi , I do not see that we need to mention about dismissed case in new H1B Application or extension ,which is done using form I-129.And in form I-129 they do not ask for any arrest ,like they do in i-485 ( GC Application) & DS-160 ( Stamping application,when go outside US).I am on F1-OPT and got into unfortunate incident, Domestic violence,which was dismissed recently.My Employer has filed for new H1-B.So can anyone having similar kind of situation can you please share your experience?( It help others , just remember when your in same boat sometime back and needed help from others).Did anyone get RFE asking for Case Documents etc?.I talked to an Attorney,he said I need to wait and see ,if there will be RFE?
