Wish you a very happy new year 2022 Currently, I got an offer from company A and they started my H1B transfer, in between when this process is going on I have received another offer from company B. Now if I plan to join company B and don't join company A will I be blacklisted from company A or will it impact on H1B transfer process and GC process in future ? Please help me with your valuable inputs
  3. Hello Experts, Hope you all are doing good. Due to recent visa bulletin for October 2020, where Eb3 category has been moved 2015, i have an question and advice needed for the same Question: I-140 approved by Employer A with priority of Dec 2014 in Eb3. In jan 2020 switched the job to new Employer B, they haven't yet filed PERM or anything, process will start after 1 year of employment completion. Can I go back to Employer A and ask for support in providing necessary documents to file my I-485 ? OR What options are left with me if EMployer A doesn't support in providing necessary documents to file my I-485 ?
  4. Hello Advisers, Need your advise, I recently did the H1B transfer and got approved till 2022, my wife's H4 Biometric is done and we waiting for her I-797 to arrive. I was planning to go for Visa stamping in Mexico, before i proceed I need few questions to be answered. Me and My wife have valid visa till June 2020. 1. As we have Indian passport, do we need Mexico tourist visa ? 2. Do I need to wait for my wife I-797 to come or she can get her visa stamped on passport based on my I-797 which is valid till 2022. 3. What all documents should i take with myself for visa stamping ? 4. Which place you suggest to visit in Mexico for H1B stamping ?
  5. Hello Team, My Priority date is 2016 and I-140 got approved in June 2017. I got an offer from Employer B and did H1B transfer. As you see we are running in year 2020, my i-140 with old employer is already crossed with him more than 180 days. Will my employer A be still able to revoke i-140 when I leave the employer A and whether my i-140 will become invalid and not usable to get future extensions ? Please help me quickly to take decision.

  8. Hello Experts/Advisors, Good morning. Hope you doing good. Please help me with your input on my spouse case. Please let me know whether my spouse is out of status or in status. Below are the Details : 1. old passport expired :09/24/2019 2. Entered in USA with old passport : 01/22/2019 3. I-94 granted till on old passport : 09/24/2019 4. Visa approved till :08/2020 7: I-797 along with I-94 validity : 08/2020. Note: On I-94 portal when checking against old passport it’s shows I-94 is expired(09/24/2019) as entry was granted till that day only. There is no record against new passport as she haven’t yet use or we haven’t been outside Usa.
  9. Hello Experts, Need your advise on H1B transfer multiple times. Scenario : Currently my H1b is in transfer from Company A to Company B. I join Company B and after 1 month I get an offer from Company C. Query : 1. Can join Company C and ask them to start H1B transfer ? 2. Which I-797 they will need to proceed with H1B transfer ? 3. Will this impact my i-140 filed and approved by previous employer ? 4. What are chances of getting RFE or denial ? 5. Can we do multiple H1B transfer and If yes, are there any consequences ? Please help me to take decision.

Hello pontevecchio, Thanks for your response, my question is can i use the same I-140 of my previous employer to get extensions further even though i have joined the employer "B" unless my PD comes? There can be scenario where my "B" employer fills the PERM or whole process after 1 yr and my extension is due in that can we use the same i-140 of "A" employer to get extension? Also what does it means when employer says we will port your i-140 PD at time of transfer ? Please help me your inputs.

Hello Team and Advisors, I have an I-140 approved from my company "A" in 2017, now i have got an better offer from company "B" and i am planning to switch, they mention they will port my i-140 priority date and will start GC after 1 yrs. It will be great if you can provide some inputs on my below query and clear my doubts 1. How much years can i get on my h1B visa transfer from company "a" to "b"? 2. Will USCIS revoke my i1-40 which is filled by company "a" ? 3. Can I continue to use my approved i-140 for further extensions with company "b" ? if yes, till how long ? 4. In case company "b" takes more time than 1 yr, can i use approved i-140 for extension once the h1b visa is about to expiry with respective to company "b"?
  12. Hello All, I was checking certain website, it clears says if USCIS feels something is fraud or fishy then they have authority to revoke the I-140, it doesn't say that after 180 days organization as right to revoke .. Could you please help with more information on the same ?
