  1. Hello, I just received my paper I-512L AP document but my photo is very badly smudged. Has anyone faced this issue and does anyone know if I need to request a new AP document and if so what's the process to do it? Thanks!
  2. Hello, I recently had my PERM approved at my current employer. During this process my previous employer was acquired by another company. Will this present any complications in porting the I-140 date from my previous employer? For my current I - 140 application, do I need to submit a new set of experience letter from my previous employer under their new name or the one which I submitted during PERM will suffice? Please advise. Thanks!
  3. Hello, I was employed by employer A and they filed my PERM and I got I-140 approved based on which my H-1B got extended beyond the 6 year period. My I-140 got approved 5 years ago. This year I switched to employer B. Now, if I wish to switch to employer C or if I want employer B to file an H-1B extension my behalf do I need a new PERM and I-140 approval from employer B or can I rely on employer A's approved I-140 to switch or renew H-1B? Please advise. Thanks.
  4. Ok, thanks. Is this something the I need to ask the company's immigration team to do or is it my responsibility?
  5. Hello, I will be starting a new job soon and was wondering if I could start remotely due to the pandemic? The LCA is approved for the company's HQ and I do eventually plan to move there once the pandemic subsides. Please advise. Thanks.
  6. Ok, thanks for the clarification. I do think though that a person will lose H1 status as soon as they lose their job. Not sure why being abroad affects that.
  7. The way lay offs were done last time around meant that people receive regular pay checks for a month and had their last day a month later so that's what I meant by not actively employed but still on company's payroll.
  8. Does that mean that I can't even avail the 2 months grace period after being laid off? In that case is the only other option to get a new visa? Does it make a difference if the employee is still on the company's payroll but not actively employed?
  9. Do you know if they typically do that? I'm not sure how the update happens. Is it just a web based system which updates instantaneously? Will I not get the 60 day grace period?
  10. Is there a rule which requires companies to inform USCIS as soon as an employee gets laid off? Do you have any idea as to how long does it take to get reflected in USCIS system?
  11. Hello, My employer has been laying people off. I am traveling abroad next month for a period of 3 weeks. I am on H-1B visa, 8th year running. I am wondering what options will I have if I get laid off during vacation? The last time my employer laid off people, they did all lay offs on a single random day which very few people saw coming or knew about. The offer they gave to laid off employees involved having them on the company's payroll for a month and then being offered a severance package. If hypothetically, I get laid off during vacation and if I get a similar package, then will that mean that I can return back to the US safely since I would still potentially be the company's payroll? What if I get severance directly and am not put on company's payroll? Is it better to postpone the vacation? Any thoughts/suggestions/ideas are welcome. Thanks
