mac112233 Posted February 18, 2013 Report Share Posted February 18, 2013 Here is my case regarding H1B amendment. I am EVC(Employer - Vendor - Client) model employer. I got my H1B approval from end client ABC till 2015. After working 3 months for end client ABC I moved to end client XYZ. Since my end client XYZ is located in different location, I had applied for H1B amendment without client letter(email is given by client saying that they cannot provide client letter). When I check status of my petition in USCIS web site it is showing 'Request for Evidence' (not yet received mail from USCIS). I have few question 1. Will my H1B visa previously approved till 2015 gets revoked, if my H1B amendment is rejected? 2. What will be my status, if my H1B amendment is rejected? 3. Can I move to a new client in case if my H1B visa status that got approved till 2015 is not revoked, after my H1B amendment is rejected? 4. Can I move to old client in case if my H1B visa status that got approved till 2015 is not revoked, after my H1B amendment is rejected? Link to comment
Attorney_11 Posted February 18, 2013 Report Share Posted February 18, 2013 Unless it is possible to resume employment per the terms and condition of the initial H-1B petition, the denial of an amendment may result in a lack of authorization to work or remain in the United States. It may be helpful to seek the counsel of a qualified immigration attorney to determine the best course of action. Link to comment
